Halle Berry's ex Olivier Martinez granted restraining order amid child abuse claims

Halle Berry’s ex, Olivier Martinez, has been granted a temporary restraining order against the actress, after he accused her of physically abusing their 12-year-old son, Maceo.

A Los Angeles County judge on Thursday approved Martinez’s request for the order, which covers both him and his preteen son, according to court records viewed by People. It requires the “Catwoman” actress to stay at least 100 yards away from her ex, though she will be allowed to see her son.

However, the order modifies the former couple’s visitation arrangement, limiting Berry’s time with Maceo to Mondays and Tuesdays between 10 a.m. and 8 p.m., and Saturdays and Sundays from 10 a.m. to 8 p.m. It said that partial custody is to be “continued to maintain communication between [Berry] and [Maceo],” while the judge also denied a request that Berry’s sobriety be monitored, citing “insufficient information.”

In court documents obtained by Variety, Martinez said Berry “physically abused our son Maceo, by jumping on him, putting her hands around his neck and choking him.” He also requested sole custody.

Berry’s attorney, Marina Beck, has pushed back against the claims Martinez has made about her client, calling them “entirely meritless and deliberately misleading.”

 

“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo — misconduct for which Mr. Martinez has already been legally sanctioned,” Beck said.

“In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior,” she continued. “Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”

Berry and Martinez met in July 2010 on the set of the film “Dark Tide” and began dating shortly after. They were married in 2013, and they welcomed Maceo later the same year. In October 2015, the pair announced they were separating and their divorce was finalized in 2023.

Berry also has an 18-year-old daughter, Nahla Ariela Aubry, with ex Gabriel Aubry
